Where and when to submit an application

The application for a residence card for the family member of an EU citizen should be submitted in person to the voivode competent for the EU citizen's place of residence, not later than the next business day after the expiration of 3 months period from the date of entry into the territory of the Republic of Poland. The requirement of personal submission does not apply to a minor. A family member who is not a citizen of the EU is immediately issued with certificate of submission of application.

Required documents:

1. 1. A completed application form for a issuance of residence card of a family member of an EU citizen;
   2. A valid travel document (original available for inspection);
   3. 5 fotos;
      Note: In the case of lack of any of the above listed documents an alien will be asked to supplement it within 7 days of receipt of the call under pain of leaving the application without consideration.
   4. Certificate of registration of residence of an UE citizen issued to a UE citizen, with whom the family member remains in the territory of the Republic of Poland;
   5. Other documents:

• in the case of a spouse of an EU citizen – document confirming contracting a marriage;
• descendant of an EU citizen or his spouse – a document confirming the existence of family ties, and proof of age or certification of dependence on the European Union citizen or his/her spouse;
• ascendant of an EU citizen or his spouse – a document confirming the existence of family ties, and certification of dependence on the European Union citizen or his/her spouse.

Note: In case of the need for explanation or clarification of the evidence in the case, which are in possession by the governmental body during the proceedings, the alien may be requested to provide additional documents or to give evidence of the circumstances referred to in the application.

Required Fees

There is no fee for an issuance of residence card of a family member of an EU citizen.

Stamp duty for filing the power of attorney – PLN 17.00

Processing time

Residence card of a family member of an EU citizen is issued not later than 6 months from the date of submission of an application for its issuance.

Information about the issued document

A family member who is not an EU citizen is obliged to have a residence card of a family member of an EU citizen, which confirms his/her right to stay in the territory of the Republic of Poland and entitling – together with a valid travel document – to multiple crossings of border without a visa.

In the course of receipt of a residence card of a family member of an EU citizen, there is a requirement of presenting valid travel document. This document may be received by an attorney. In this case, in the course of receipt of the document the applicant's attorney presents travel document of a family member of an EU citizen and an authorisation to receive the card.

Residence card of a family member of an EU citizen is valid for five years, and if the intended duration of stay of an EU citizen in the territory of the Republic of Poland with whom a family member resides or wishes to join is less than 5 years, this document is valid for the intended period of stay of an EU citizen.

Penalties for failure to obtain a residence card of a family member of an EU citizen

Evasion of the obligation to have a residence card of a family member of a citizen is subject to a fine.
